Overview

This website and online store are operated by CuteFurCompanions. Throughout these Terms, the terms “we”, “us”, “our”, and “CuteFurCompanions” refer to CuteFurCompanions.

We provide this website, our products, customer accounts, content, features, and related services together as the “Services”.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

By accessing our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms of Service together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies that apply to your purchase.

Please read these Terms carefully before using the Services.

Nothing in these Terms excludes or limits any consumer right or remedy that cannot legally be excluded under the laws applicable to you.

1. Eligibility and customer accounts

You must have the legal capacity required in your jurisdiction to enter into a purchase contract.

When using our Services, you agree to provide accurate, current, and complete information, including your:

• Name.
• Email address.
• Billing information.
• Shipping information.
• Payment information.
• Other information reasonably required to process your order.

You are responsible for maintaining the security of your account and access credentials.

You must not use another person's identity, payment method, account, or information without authorization.

We may restrict or suspend an account where reasonably necessary to protect customers, prevent fraud, comply with law, or protect the security of our Services.

2. Our products

We make reasonable efforts to display and describe our products accurately.

However, slight differences may occur between the product shown on your screen and the physical product you receive because of factors such as:

• Garment or material variations.
• Printing methods.
• Production tolerances.
• Differences between production facilities.
• Lighting used in product photography or mockups.

Minor variations that fall within reasonable manufacturing tolerances are not necessarily product defects.

This does not affect your rights where a product is defective, materially different from its description, incorrectly supplied, unsafe, or otherwise does not comply with applicable consumer law.

Product designs, descriptions, variants, availability, and prices may be changed or discontinued for future orders without notice.

3. Made-to-order production

Most CuteFurCompanions products are produced on demand after an order is placed.

We use professional third-party production, printing, fulfillment, and shipping providers to manufacture and deliver products on our behalf.

These providers assist CuteFurCompanions with fulfillment. They are not the retailer from whom you purchase the product.

Your purchase is made from CuteFurCompanions, and questions concerning your order, refunds, replacements, cancellations, delivery, or customer rights should be directed to us.

Because production can begin shortly after an order is placed, the ability to voluntarily cancel or modify an order can become limited once production begins.

Any mandatory statutory cancellation or withdrawal rights remain unaffected.

4. Orders and acceptance

When you submit an order, you are making an offer to purchase the products shown in your order.

We may decline or cancel an order before fulfillment where reasonably necessary because of circumstances such as:

• Payment failure.
• Suspected fraud or unauthorized payment.
• Product unavailability.
• An obvious pricing or listing error.
• An inability to deliver to the destination provided.
• Legal or regulatory restrictions.
• A violation of these Terms.
• Another legitimate operational reason.

If we cancel an order after payment has been collected, we will refund the applicable amount.

Where applicable law determines when a purchase contract is formed, that law takes priority over this section.

5. Order accuracy

Please review your order carefully before submitting it.

You are responsible for checking information including:

• Product.
• Design.
• Size.
• Color.
• Variant.
• Quantity.
• Shipping address.
• Contact information.
• Shipping method.

If you discover an error, contact us as soon as possible at support@cutefurcompanions.com.

Once production begins, we might no longer be able to change or cancel the order.

Our Return & Refund Policy explains how cancellations, incorrect selections, manufacturing problems, and other order issues are handled.

6. Prices, taxes, and payment

Product prices are displayed according to the market, currency, and settings available to you.

The final amount payable will be shown during checkout before you complete your purchase.

Where applicable law requires taxes to be included in displayed consumer prices, we will display pricing accordingly.

In markets where taxes are calculated separately, applicable taxes may be added during checkout.

Shipping charges and other charges that can reasonably be calculated before purchase will be displayed before you submit your order.

International orders may be subject to:

• VAT.
• Sales tax.
• Customs duties.
• Import taxes.
• Brokerage charges.
• Government processing fees.
• Similar import-related charges.

Where these amounts are collected by CuteFurCompanions during checkout, they will be included in the order total.

Where they are not collected by us, additional charges may become payable upon import or delivery as permitted by applicable law.

You represent that you are authorized to use the payment method provided with your order.

7. Shipping and delivery

Shipping is governed by our Shipping Policy.

Production and delivery times are estimates unless we expressly state that a particular delivery date is guaranteed.

Products in the same order may occasionally be produced at different locations and arrive in separate packages.

CuteFurCompanions remains responsible for delivery to the extent required by applicable law.

We do not transfer the risk of loss to a consumer earlier than applicable law permits.

Where applicable consumer law provides that risk remains with the seller until the customer, or another person nominated by the customer, takes physical possession of the goods, that rule applies.

If your order is lost, damaged, substantially delayed, or incorrectly delivered, please follow the procedure described in our Return & Refund Policy.

8. Returns, refunds, replacements, and cancellations

Returns, refunds, reprints, replacements, exchanges, and cancellations are governed by our Return & Refund Policy.

Because our products are made on demand, we do not ordinarily provide voluntary returns or exchanges merely because a customer:

• Selected the wrong size.
• Selected the wrong color.
• Selected the wrong variant.
• Changed their mind.
• No longer wants the product.

This does not override a mandatory right of withdrawal, cancellation, return, refund, replacement, repair, legal guarantee, or other remedy provided by applicable consumer law.

A standard CuteFurCompanions design is not considered individually personalized solely because it is manufactured after the order is placed.

9. Product defects and manufacturing variations

If a product is damaged, defective, misprinted, incorrectly manufactured, or incorrectly fulfilled, please contact us in accordance with our Return & Refund Policy.

We may reasonably request photographs, measurements, packaging information, or other evidence necessary to assess an issue.

Normal manufacturing tolerances and minor variations are not automatically considered defects.

However, nothing in this section limits your rights where a product is materially defective, materially different from its description, unsafe, incorrectly supplied, or otherwise legally non-conforming.

10. Product safety and care

Customers should follow all applicable:

• Product-care instructions.
• Washing instructions.
• Safety information.
• Age restrictions.
• Warnings.
• Usage instructions.

Where legally required, product-specific manufacturer information, responsible-person information, warnings, safety information, or other regulatory disclosures may be provided on the product page, product label, packaging, or accompanying documentation.

Damage caused after delivery through misuse, incorrect care, unauthorized alteration, or ordinary wear is not considered a manufacturing defect unless applicable law provides otherwise.

11. Intellectual property

Unless otherwise stated, the CuteFurCompanions name, branding, original artwork, designs, graphics, photographs, written content, product presentation, website content, and other materials owned by or licensed to CuteFurCompanions are protected by applicable intellectual-property laws.

You may access and use our Services for lawful personal purposes.

You must not, without authorization:

• Reproduce our protected artwork or designs.
• Sell or commercially exploit our content.
• Republish substantial portions of our website.
• Create unauthorized merchandise using our designs.
• Use our branding in a way that suggests affiliation or endorsement.
• Remove or alter intellectual-property notices.
• Infringe the intellectual-property rights of CuteFurCompanions or any third party.

Nothing in these Terms grants you ownership of our intellectual property.

Third-party trademarks, names, and logos remain the property of their respective owners.

12. Reviews, photographs, and customer content

You may be able to submit reviews, photographs, feedback, comments, or other content through our Services.

You must only submit content that you have the right to provide.

Customer content must not:

• Contain materially false or misleading information.
• Infringe another person's intellectual-property rights.
• Violate another person's privacy rights.
• Contain unlawful or malicious material.
• Impersonate another person.
• Include fabricated purchasing experiences presented as genuine.

Where you voluntarily submit content for publication, you grant CuteFurCompanions a non-exclusive, worldwide, royalty-free right to display, reproduce, format, and use that content in connection with operating and promoting our Services, subject to applicable law and our Privacy Policy.

We may remove unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate content.

We will not knowingly present fabricated reviews as genuine customer reviews.

The use of third-party service providers does not remove CuteFurCompanions' responsibilities to customers where those responsibilities apply by law.

14. Relationship with Shopify

Our online store is powered by Shopify.

Shopify provides technology and related services that enable us to operate our online store.

Products purchased from CuteFurCompanions are sold by CuteFurCompanions, not by Shopify.

CuteFurCompanions is responsible for customer orders, fulfillment arrangements, customer support, returns, refunds, and complaints relating to products purchased from us.

Personal information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy notices.

15. Privacy

Our collection, use, processing, retention, and disclosure of personal information are governed by our Privacy Policy.

Our store uses Shopify and other service providers necessary to operate, secure, fulfill, analyze, and improve our Services.

Depending on where you live, you may have rights concerning your personal information, including rights to access, correct, delete, restrict, object to certain processing, or opt out of certain uses.

16. Prohibited uses

You may use our Services only for lawful purposes.

You must not use the Services to:

• Submit materially false or misleading information.
• Use an unauthorized payment method.

We may cooperate with payment providers, carriers, Shopify, authorities, or other appropriate parties when reasonably necessary to investigate suspected fraud or comply with law.

Nothing in this section allows us to deny a statutory consumer right or remedy.

18. Errors and inaccuracies

Occasionally, our website may contain genuine errors relating to matters such as:

• Shipping charges.

• Product specifications.

We may correct genuine errors when discovered.

Where an order is affected by a material and obvious error, we may contact you to offer the corrected transaction or cancel and refund the affected order where permitted by law.

We will not use this provision to retrospectively alter a valid transaction simply because it later becomes commercially unfavorable to us.

19. Availability of the Services

We aim to keep our website and Services available and functioning properly.

However, uninterrupted availability cannot be guaranteed.

This does not affect rights that have already arisen from an accepted order.

20. Warranties and mandatory consumer rights

Products are supplied subject to all warranties, guarantees, conformity requirements, and consumer rights that apply under applicable law.

Nothing in these Terms excludes or limits:

• Rights relating to goods that do not match their description.
• Mandatory implied warranties.

• Mandatory product-safety rights.
• Mandatory refund, repair, or replacement rights.
• Any other consumer protection that cannot legally be excluded.

To the maximum extent permitted by law, we do not provide additional warranties beyond those expressly stated by CuteFurCompanions.

21. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

This includes liability that cannot legally be excluded for matters such as fraud, fraudulent misrepresentation, mandatory consumer remedies, mandatory product liability, or personal injury where applicable law prohibits exclusion.

To the maximum extent permitted by applicable law, CuteFurCompanions will not be responsible for indirect or consequential commercial losses that were not reasonably foreseeable when the relevant contract was entered into.

If you are purchasing as a consumer, this section remains subject to all mandatory consumer-protection laws applicable to you.

22. Events outside our reasonable control

We are not responsible for a failure or delay caused solely by circumstances reasonably outside our control to the extent permitted by applicable law.

These circumstances may include:

• Severe weather.
• Natural disasters.
• War or civil disturbance.
• Government restrictions.
• Customs disruption.
• Major carrier disruption.
• Labor disruption.
• Widespread infrastructure failure.
• Major production-system interruption.

Where applicable law requires us to provide a notice, cancellation option, refund, replacement, or other remedy despite such an event, we will provide that remedy.

23. Responsibility for unlawful misuse

To the extent permitted by applicable law, you are responsible for losses directly caused by your unlawful use of our Services, deliberate violation of these Terms, fraud, or infringement of another person's rights.

This section does not create liability for ordinary use of our Services and does not limit mandatory consumer rights.

24. Termination or restriction of access

We may suspend or terminate access to an account or to parts of our Services where reasonably necessary because of:

• Fraud.
• Security concerns.
• Unlawful activity.
• Material violation of these Terms.
• Repeated abuse of our systems.
• Legal or regulatory requirements.

Termination of website or account access does not remove rights or obligations relating to orders already placed where those rights or obligations continue to apply.

25. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will apply only to the maximum extent legally permitted.

The remaining provisions will continue in effect.

26. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.

27. Entire agreement

These Terms, together with the policies expressly incorporated into them, form the agreement governing your use of our Services and purchases from CuteFurCompanions.

Nothing in this section excludes representations, disclosures, or consumer rights that applicable law requires to form part of your contract.

28. Assignment

You may not transfer contractual rights or obligations in a manner that would violate applicable law or materially prejudice CuteFurCompanions without our consent.

We may transfer our rights or obligations as part of a legitimate business restructuring, sale, merger, or similar transaction where permitted by law.

A transfer will not reduce any mandatory consumer rights that have already arisen.

29. Governing law

Except where mandatory consumer law provides otherwise, these Terms and contracts entered into with CuteFurCompanions are governed by the laws of India and the laws applicable in the state in which CuteFurCompanions is established.

Nothing in this section deprives a consumer of mandatory protections, remedies, or jurisdictional rights provided by the laws applicable in the consumer's country or place of residence.

Where mandatory consumer law allows you to bring a claim before a court or consumer authority in your place of residence, these Terms do not remove that right.

30. Changes to these Terms

We may update these Terms from time to time to reflect changes in:

• Our business operations.
• Applicable law.
• Regulatory requirements.
• Security practices.

The current version will be published on this page together with its “Last updated” date.

Material changes will apply prospectively unless applicable law permits otherwise.

Updating these Terms will not retrospectively remove rights that arose from an order placed before the change.
